1. Acceptance of Terms
By accessing or using HabitCove at habitcove.com ("the Service"), operated by Prince Kumar Pankaj, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use the Service. These terms apply to all visitors, users, and others who access or use the Service.
2. Definitions
- "Service" refers to the HabitCove web application available at habitcove.com, including all features, content, and functionality.
- "User" / "You" refers to any individual who accesses or uses the Service.
- "We" / "Us" / "Our" refers to HabitCove, owned and operated by Prince Kumar Pankaj.
- "Subscription" refers to a paid plan (Oak) that provides access to premium features.
3. Eligibility
You must be at least 13 years of age to use HabitCove. By using the Service, you represent and warrant that you meet the eligibility requirements. If you are under 18, you must have parental or guardian consent to use the Service.
4. User Accounts
When you create an account with us, you must provide accurate, complete, and up-to-date information. By creating an account, you also consent to receive transactional emails related to your account activity (see Section 18). You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password. You agree not to share your account credentials with any third party.
5. Subscription Plans & Payments
HabitCove offers free (Seedling) and paid (Oak) subscription plans. By selecting a paid plan, you agree to pay all fees associated with the plan you select.
- All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes.
- Payments are processed securely through Razorpay, our authorized payment gateway. HabitCove does not store your full credit card, debit card, or bank account details.
- Subscriptions are billed on a monthly or annual basis, depending on your chosen billing cycle.
- Failed payments may result in suspension of premium features until payment is resolved.
6. Auto-Renewal & Recurring Payments
By subscribing to a paid plan, you explicitly agree to the following auto-renewal terms as required by RBI (Reserve Bank of India) guidelines:
- Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle (monthly or annual) unless you cancel before the renewal date.
- Recurring Charges: You authorize HabitCove and Razorpay to charge your selected payment method on a recurring basis at the then-current subscription rate.
- Pre-Renewal Notification: We will send you a reminder email at least 24 hours before your subscription renews, notifying you of the upcoming charge.
- Cancellation: You may cancel auto-renewal at any time from your Profile Settings within the app. Cancellation takes effect at the end of the current billing period.
- Price Changes: If subscription pricing changes, we will notify you in advance. Continued use after the price change constitutes acceptance of the new pricing.
7. Taxes
All applicable taxes, including GST (Goods and Services Tax) as per Indian law, are included in the displayed prices. You are responsible for any additional taxes that may apply based on your jurisdiction.
8. Digital Service — No Physical Goods
HabitCove is a 100% digital service. No physical goods, products, or merchandise are sold, shipped, or delivered. Upon successful payment, premium features are activated instantly via the web application. For more details, please refer to our Shipping & Delivery Policy.
9. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of HabitCove. The Service is protected by copyright, trademark, and other laws of India. Our trademarks and trade dress may not be used without our prior written consent.
10. User Content
You retain ownership of all data, habits, dreams, and other content you create within HabitCove. By using the Service, you grant us a limited license to store and process your content solely for the purpose of providing the Service to you.
11. Prohibited Uses
You agree not to use the Service:
- For any unlawful purpose or to solicit others to perform illegal acts.
- To violate any international, national, or local regulations.
- To transmit any malicious code, viruses, or harmful data.
- To attempt unauthorized access to the Service or its related systems.
- To impersonate any person or entity, or misrepresent your affiliation.
- To scrape, crawl, or use automated tools to extract data from the Service.
12. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately.
13. Account Deletion
You have the right to request permanent deletion of your account and all associated data at any time. Here is how account deletion works:
- How to Request: You can request account deletion from Settings → Delete Account within the app. You will be required to type "DELETE" to confirm your intent.
- Processing Time: Once submitted, your deletion request enters a 10-day review period.
- Activity-Based Processing: If you continue to log in or use the app after submitting a deletion request, your request will be considered withdrawn and your account will remain active. Deletion is only carried out if no further activity is detected during the review period.
- What Gets Deleted: All your personal data including habits, dreams, to-do items, weekly/monthly intentions, profile information, and subscription records will be permanently deleted.
- Cancellation of Request: If you change your mind, simply continue using the app and your request will be automatically cancelled. You may also contact us at support@habitcove.com to cancel the request.
- Active Subscriptions: If you have an active paid subscription, it will be cancelled upon account deletion. Any remaining subscription period will be forfeited. We recommend cancelling your subscription first if you wish to use the service until the end of your billing cycle.
- Irreversibility: Once your account is permanently deleted, this action cannot be undone. You will need to create a new account if you wish to use HabitCove again.
- Re-registration Cooldown: After account deletion, you may not be able to register with the same email address for up to 20 days.
14. Limitation of Liability
In no event shall HabitCove, its owner, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.
15. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or the Service:
- Step 1 — Contact Us: You agree to first attempt to resolve the dispute informally by contacting us at support@habitcove.com. We will endeavour to resolve the matter within 30 days.
- Step 2 — Grievance Officer: If unresolved, you may escalate the matter to our Grievance Officer at grievance@habitcove.com.
- Step 3 — Jurisdiction: If the dispute remains unresolved, it shall be subject to the exclusive jurisdiction of courts in Nalanda, Bihar, India.
16. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and other applicable laws. Any disputes shall be subject to the exclusive jurisdiction of courts in Bihar, India.
17. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of any changes by updating the "Last updated" date and, for material changes, by sending an email notification. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
18. Email Communications & Consent
By creating an account on HabitCove, you expressly consent to receive transactional emails from us. These are essential communications necessary for the operation of the Service and include:
- Account Verification: Email verification links sent during registration to confirm your identity.
- Password Reset: Emails sent when you request to reset your account password.
- Security Alerts: Notifications about login attempts, account changes, or suspicious activity on your account.
- Subscription & Payment: Payment confirmations, subscription renewal reminders (sent at least 24 hours before renewal), and billing-related communications.
- Service Notifications: Important updates about the Service, including changes to these Terms, downtime notifications, or feature updates that affect your account.
All emails are sent from no-reply@habitcove.com, support@habitcove.com, or grievance@habitcove.com. We do not send marketing, promotional, or bulk emails. These transactional emails are a necessary part of the Service and cannot be opted out of while maintaining an active account. If you no longer wish to receive any emails, you may delete your account as described in Section 13.
